What’s Changing in the in the Residential Tenancies Act (RTA)?

Smoke Alarms
By 1 July 2016 all residential rental properties covered by the RTA must:
- Have a minimum of one working smoke alarm within 3m of each bedroom door, and have a minimum of one working smoke alarm in any self-contained caravan, sleep out or similar.
- Have one smoke alarm on each level within the household in multi-story units.
- Have long life photoelectric smoke alarms installed where there are no existing alarms, and when any existing smoke alarm is replaced. Hard wired smoke alarms are acceptable.
All smoke alarms must be replaced in accordance with the manufacturer’s recommended replacement date stated on the alarm. All new and replacement smoke alarms in rental properties are to be installed in accordance with placement requirements provided in the manufacturer’s instructions.

Our Smoke Alarm Compliance Service includes an audit and service of existing smoke alarms, and where necessary to meet new RTA requirements, installation of new long-life photoelectric alarms.
Once the property meets the new requirements, we’ll provide you with a statement of compliance that landlords can include in their tenancy agreements.

Insulation
By 1 July 2016, landlords must for residential properties be covered by the RTA:
- for any new Tenancy Agreement, make a statement in the tenancy agreement on the extent of and details about the insulation installed in their residential property
By 1 July 2019, landlords must, for residential rental properties covered by the RTA:
- make a statement in the tenancy agreement on the extent of, and details about, the insulation installed in their residential property;
- have ceiling and underfloor insulation that at the time of installation would have met or exceeded the 1978 Standard Permitted Combinations for Type A Construction(NZS 4218P:1977);
- ensure that where existing insulation does not meet the minimum thermal requirements specified in the regulations (including if it is incomplete, damaged, or damp), that it is replaced, topped up, and/or remediated to meet current Building Code requirements;
- ensure that all insulation retrofitted or installed in rental properties after 1 July 2016 is installed in accordance with the New Zealand Standard Energy Efficiency NZS4246:2006 Installing Insulation.”
What We offer
Our Insulation Compliance Audit is only $60 for an assessment of whether a property meets the new Residential Tenancy Act requirements for insulation.
As part of the Insulation Compliance Audit we will provide you with recommendations and a no obligation quote to bring the insulation in the property up to standard. If the property meets the new requirements, we’ll provide you with a statement of compliance that landlords can include in their tenancy agreements.
